Caldo Caldo, LLC ("Company") offers this limited lifetime warranty and a separate C-Shell lifetime replacement service contract to the original retail purchaser and owner ("Consumer") of the TOPSTYLER™ for an additional $19.99.

BEFORE ANY CLAIMS MAY BE MADE UNDER THIS WARRANTY, THE CONSUMER MUST HAVE PAID IN FULL FOR THE PRODUCT COVERED UNDER THE WARRANTY, ACCORDING TO THE TERMS AND CONDITIONS OF THE PAYMENT PLAN SPECIFIED IN THE ORIGINAL PURCHASE ORDER. IF THE CONSUMER HAS FAILED TO MAKE ALL PAYMENTS IN FULL ACCORDING TO THE SPECIFIC PAYMENT PLAN FOR THE PRODUCT, THIS WARRANTY SHALL BE VOIDED AND COMPANY SHALL BE RELIEVED FROM ANY RESPONSIBILITY OR LIABILITY UNDER THIS WARRANTY.

LIMITED LIFETIME WARRANTY

The TOPSTYLER™ C-Shells, are warranted against manufacturer defects for as long as the Consumer owns the TOPSTYLER™(the "Warranty Period"). This limited warranty only covers the items specifically listed above within the Warranty Period, and up to 10 C-Shells per year. THE CONSUMER MUST PROVIDE PROOF OF PURCHASE WITH ANY WARRANTY CLAIM.

1. EXCLUSIONS:

Excluded from this limited warranty are damages to the TOPSTYLER™ and its parts caused by unreasonable or unintended use, abuse or neglect. Also excluded is damage from ordinary wear and tear.

2. VOIDING OF LIMITED WARRANTY:

THE FOLLOWING OCCURENCES OR CONDITIONS WILL VOID THIS LIMITED WARRANTY: (1) USE OF THE TOPSTYLER™ FOR COMMERCIAL PURPOSES; (2) FAILURE TO USE THE TOPSTYLER™ ACCORDING TO COMPANY'S SPECIFICATIONS AND INSTRUCTIONS INCLUDING, WITHOUT LIMITATION, SAFETY INSTRUCTIONS AND WARNINGS; (3) FAILURE TO PROPERLY CLEAN AND MAINTAIN THE TOPSTYLER™ AS STATED IN THE MANUAL; AND (4) TRANSFER OR ASSIGNMENT OF THIS WARRANTY.

THE CONSUMER IS NOT ENTITLED TO A REFUND IF THE LIMITED LIFETIME WARRANTY AND THE C-SHELL LIFETIME REPLACEMENT SERVICE CONTRACT ARE CANCELED BY THE CONSUMER FOR ANY REASON.

3. SOLE REMEDY:

The sole remedy under this limited warranty is repair or replacement, at Company's option, of the TOPSTYLER™ or part(s) deemed to be defective. "Repair" or "Replacement" shall mean providing the labor and materials necessary, at no cost to the Consumer, to repair or replace defective part(s) or replace, at Company's option, the TOPSTYLER™. NO REFUNDS OR CREDITS WILL BE ISSUED.

4. HOW TO MAKE A WARRANTY CLAIM:

To present a claim under this limited warranty, YOU MUST CALL THE TELEPHONE NUMBER BELOW AND SPEAK WITH A CUSTOMER SERVICE REPRESENTATIVE IN ORDER TO CONFIRM YOUR PURCHASE AND TO RECEIVE A RETURN AUTHORIZATION. 5. DISCLAIMER:

THE WARRANTY IN THIS DOCUMENT IS THE ONLY WARRANTY ON THE TOPSTYLER™ AND ITS PARTS. TO THE FULLEST EXTENT PROVIDED BY APPLICABLE LAW, COMPANY MAKES NO OTHER WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. COMPANY MAKES NO OTHER REPRESENTATION OR WARRANTY OF ANY KIND, AND NO REPRESENTATIVE, EMPLOYEE, OR DISTRIBUTOR OR DEALER OF COMPANY HAS THE AUTHORITY TO MAKE OR IMPLY ANY REPRESENTATION, PROMISE OR AGREEMENT WHICH IN ANY WAY VARIES THE TERMS OF THIS LIMITED WARRANTY.

6. NO CONSEQUENTIAL DAMAGES:

TO THE FULLEST EXTENT PROVIDED BY APPLICABLE LAW, COMPANY ASSUMES NO LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES INCLUDING, WITHOUT LIMITATION, LOSS RELATED TO PROPERTY, LOSS OF USE, LOSS OF REVENUE, LOSS OF TIME, INCONVENIENCE, OR ANY OTHER ECONOMIC LOSS.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

8. INFORMAL DISPUTE RESOLUTION:

The parties to this limited warranty agree to submit to mediation to resolve any warranty disputes.

3-YEAR EXTENDED SERVICE CONTRACT

1. EXTENDED SERVICE CONTRACT: Caldo Caldo, LLC ("Company") offers this three (3) year extended service contract to the original retail purchaser ("Consumer") of the TOPSTYLER™ for an additional $9.95.

BEFORE ANY REQUESTS MAY BE MADE UNDER THIS CONTRACT, THE CONSUMER MUST HAVE PAID IN FULL FOR THE PRODUCT COVERED UNDER THE CONTRACT, ACCORDING TO THE TERMS AND CONDITIONS OF THE PAYMENT PLAN SPECIFIED IN THE ORIGINAL PURCHASE ORDER. IF THE CONSUMER HAS FAILED TO MAKE ALL PAYMENTS IN FULL ACCORDING TO THE SPECIFIC PAYMENT PLAN FOR THE PRODUCT, THIS CONTRACT SHALL BE VOIDED AND COMPANY SHALL BE RELIEVED FROM ANY RESPONSIBILITY OR LIABILITY UNDER THIS CONTRACT.

The THREE (3) YEAR EXTENDED SERVICE CONTRACT covers the TOPSTYLER™ base unit and its parts, including the TOPSTYLER™ C-Shells, against manufacturer defects. Coverage under this extended service contract begins when the manufacturer’s one (1) year Limited Warranty ends and continues for an additional three (3) years. THE CONSUMER MUST PROVIDE PROOF OF PURCHASE WITH ANY SERVICE REQUEST.

2. EXCLUSIONS: Excluded from this extended service contract are damages to the TOPSTYLER™ and its parts caused by unreasonable or unintended use, abuse or neglect. Also excluded is damage from ordinary wear and tear.

C-SHELL LIFETIME REPLACEMENT SERVICE CONTRACT

1. C-SHELL LIFETIME REPLACEMENT SERVICE CONTRACT: Caldo Caldo, LLC ("Company") offers this C-Shell lifetime replacement service contract and a separate limited lifetime warranty to the original retail purchaser and owner ("Consumer") of the TOPSTYLER™ for an additional $19.99. Following the one (1) year anniversary of the date of purchase of the TOPSTYLER™ by the Consumer, for as long as the Consumer owns the TOPSTYLER™ and upon the request of the Consumer, Company shall replace up to a maximum of ten (10) TOPSTYLER™ C-Shells per year for any reason, including ordinary wear and tear. The Consumer must call the Customer Service Toll Free Telephone Number (800) 474-7213 to request the TOPSTYLER™ C-Shells, which come in packages of either five (5) large C-Shells or five (5) small C-Shells. For each replacement shipment made by Company, the Consumer agrees to pay $4.99 for shipping and handling. The Consumer is not required to send back used C-Shells in order to receive replacement C-Shells. THE CONSUMER MUST PROVIDE PROOF OF PURCHASE WITH ANY REPLACEMENT SERVICE REQUEST.

BEFORE ANY REQUESTS MAY BE MADE UNDER THIS CONTRACT, THE CONSUMER MUST HAVE PAID IN FULL FOR THE PRODUCT COVERED UNDER THE CONTRACT, ACCORDING TO THE TERMS AND CONDITIONS OF THE PAYMENT PLAN SPECIFIED IN THE ORIGINAL PURCHASE ORDER. IF THE CONSUMER HAS FAILED TO MAKE ALL PAYMENTS IN FULL ACCORDING TO THE SPECIFIC PAYMENT PLAN FOR THE PRODUCT, THIS CONTRACT SHALL BE VOIDED AND COMPANY SHALL BE RELIEVED FROM ANY RESPONSIBILITY OR LIABILITY UNDER THIS CONTRACT.

VOIDING OF THE REPLACEMENT SERVICE CONTRACT: THE FOLLOWING OCCURRENCES OR CONDITIONS WILL VOID THIS REPLACEMENT SERVICE CONTRACT: (1) USE OF THE TOPSTYLER™ FOR COMMERCIAL PURPOSES; (2) FAILURE TO USE THE TOPSTYLER™ ACCORDING TO COMPANY'S SPECIFICATIONS AND INSTRUCTIONS INCLUDING, WITHOUT LIMITATION, SAFETY INSTRUCTIONS AND WARNINGS; AND (3) TRANSFER OR ASSIGNMENT OF THIS REPLACEMENT SERVICE CONTRACT.

THE CONSUMER IS NOT ENTITLED TO A REFUND IF THE C-SHELL LIFETIME REPLACEMENT SERVICE CONTRACT AND THE LIMITED LIFETIME WARRANTY ARE CANCELED BY THE CONSUMER FOR ANY REASON.

3. SOLE REMEDY: The sole remedy under this replacement service contract is replacement of the TOPSTYLER™ C-Shells in accordance with the terms hereof. NO REFUNDS OR CREDITS WILL BE ISSUED.

4. HOW TO MAKE A REPLACEMENT SERVICE CONTRACT REQUEST: To present a request under this replacement service contract, YOU MUST CALL THE TELEPHONE NUMBER BELOW AND SPEAK WITH A CUSTOMER SERVICE REPRESENTATIVE IN ORDER TO CONFIRM YOUR PURCHASE. Thereafter, replacement TOPSTYLER™ C-Shells will be shipped to the Consumer at no charge to the Consumer.
